Can a claimant avoid losing the right to make their claim?

The claimant will have to ‘show cause’ or explain why their claim should not be declared abandoned. Here are some examples of what to do:


If the claimant… Then the claimant should:
has medical reasons for failing to comply with the process provide a medical certificate that complies with the Refugee Protection Division's requirements.
failed to file the Basis of Claim Form on time file the completed Basis of Claim Form as soon as possible or, at the latest, bring it to the special hearing.
failed to appear at the refugee protection hearing be prepared on the day of the special hearing to proceed with the refugee protection hearing.
