Can the hearing date be changed?

A claimant can apply to the Immigration and Refugee Board to change the date or time of the hearing. In most cases, a claimant must show ‘exceptional circumstances’ before the Board will agree to the change. Here are some examples that might be considered exceptional circumstances:

  • The change is needed to accommodate a ‘vulnerable person’.
  • There has been an emergency or some other event beyond the control of the claimant or their lawyer. The claimant must show that they took reasonable steps to deal with it. If the emergency was medical, the claimant must provide a doctor’s note or other medical evidence.
