What if the claimant's lawyer cannot attend on the hearing date?
A hearing date may also be changed if the claimant did not have a lawyer or did not know their lawyer's schedule when the hearing date was set. They can ask to change their hearing date if they meet all of these conditions:
- They hired the lawyer within five working days after the hearing date was set.
- They apply for the change of date in writing within five working days after the hearing date was set.
- They provide at least three dates and times that fall within their hearing time limit (30, 45, or 60 days). These dates must also be within 10 days of the original hearing date.
